Intellectual Property Rights Policy
Minisgiftshopus.com provides an internet-based platform that allows users to design and sell their own T-shirts and other merchandise. We strictly prohibit users from designing or selling merchandise that infringes on the intellectual property rights of third parties (including but not limited to copyright, trademark, and related rights). If you believe that a user of the Minisgiftshopus.com service has infringed on your intellectual property rights, please follow the procedure outlined below to report the issue.
Procedure for Reporting Intellectual Property Infringement
It is Minisgiftshopus.com’s policy to:
- Block access to or remove any content (including, but not limited to, text, graphics, and photos) that is believed in good faith to infringe on the intellectual property rights of third parties upon receipt of a valid notice.
- Remove and discontinue service to repeat infringers.
If you believe that content hosted on or accessible through the Minisgiftshopus.com service infringes your copyright or intellectual property rights, please send a notice of infringement containing the following details to the Designated Agent listed below:
- Identification of the copyrighted work or other intellectual property that has been infringed, including the registration number(s) if applicable.
- Identification of the infringing content, including:
- A description of how the material is being used in an infringing manner.
- A description of where the material is located on the Minisgiftshopus.com platform, with sufficient details for us to verify its existence.
- Your contact information, including full name, mailing address, telephone number, and email address.
- A statement by you, made in good faith, that the disputed use of the copyrighted work or other intellectual property is not authorized by the rights holder, its agents, or the law.
- A statement by you, made under penalty of perjury, that the information provided in your notice is accurate and that you are the rights holder or are authorized to act on behalf of the rights holder.
- An electronic or physical signature of the person authorized to act on behalf of the rights holder.
Once a Proper Infringement Notification Is Received
Minisgiftshopus.com will:
- Remove or disable access to the allegedly infringing content.
- Notify the member whose content has been removed or disabled.
- Terminate the service of repeat offenders and remove their infringing content from the platform.
Procedure to Submit a Counter-Notice
If you believe that the removed or disabled content is not infringing, or if you have authorization to post and use such content from the rights owner, the owner’s agent, or under applicable law (including fair use), you may submit a counter-notice with the following details to the Designated Agent:
- Identification of the content that has been removed or disabled, along with a description of where it appeared on the Minisgiftshopus.com platform before removal.
- A statement by you, made under penalty of perjury, that you have a good faith belief that the content was removed or disabled due to a mistake or misidentification.
- Your contact information, including full name, mailing address, telephone number, and email address.
- A statement by you consenting to the jurisdiction of the Federal Court in the judicial district where your address is located, or if outside the USA, the judicial district where Minisgiftshopus.com is located, and that you will accept service of process from the original complaining party.
- Your electronic or physical signature.
If a counter-notice is received, Minisgiftshopus.com may send a copy to the original complaining party, informing them that the removed content may be reinstated within 10 business days. If the rights owner does not file a legal action seeking a court order, the removed content may be restored within 10 to 14 business days at Minisgiftshopus.com‘s discretion.
Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that content or activity is infringing may be held liable for damages, including attorney’s fees.
